General Data Protection Regulamin (GDPR)

GDPR, What is this?

GDPR is the European law regulation for main principles of personal data protection that would be approved since May 25, 2018. From that day, our company complies with the rules set out in the GDPR.

Full title of GDPR: Regulation of the European Parliament and the Council (EU) 2016/679 from the 27^th of April 2016 means the protection of private persons with regard to the processing of personal data and free movement of such data and, also, abolishing of the Directive 95/46 / EU.

Who is the data administrator?

The data administrator of the clients is the company Tora-Zajdel II Sp. z o.o. with the head office in Poland, Świdnica (58-100), ul. Kliczkowska 41.

Why will we use the our clients data and main principles of the regulation?

We’ll use the data of our clients in the followings cases:

·         conclusion and execution of the contract, including the quality of services (legal basis - Article 6, 1, “b” of the GDPR) - "Execution of the contract",

·         execution of the legal obligations of our company, such as issuing and storing invoices or responding to complaints (legal basis - Article 6, 1, “c” of the GDPR) - "Legal obligation",

·         claims  pursuing under the contract (legal basis - Article 6, 1, “f” of the GDPR) - "Legitimate interests"

·         marketing of own services during the term of the contract (legal basis - Article 6, 1, “f” of the GDPR) - "Legitimate interests",

·         marketing services if our client would agree to the use the information for this purpose (legal basis - Article 6, 1, “a” of the GDPR) - "Agreement".

How much time we will use the data

We will use the data for the period necessary to achieve the goals described below. Depending on the legal basis, it will be in the next cases:

• duration of the contract

• during the time for executing of the legal obligations and during the time required by the law to store this information, for example, tax legislation,

• during the time when the validity of claims under the contract will finish,

• until the agreement would be abolished.

What are your rights?

You can apply to our company for:

• access to your personal data (information about processing data and receiving the copy of this information);

• correction of data if they are incorrect;

• removing or restricting of personal data processing;

Without reference to the above-mentioned rights, you may protest against processing your data at any time if the juridical basis of using your data is a legitimate interest. After accepting your application form, we are obliged to stop processing data in this purpose.

You also have right to send any complaint letter to the President or to the head office for the Protection of Personal Data if you consider that the processing of your personal data frustrate the law.

The agreement, given for the data processing for marketing purposes, could be abolished at any time.

Who receives your processed data?

To keep all rules of our clients security information, your data may be transferred - except the Authorities, indicated by the Administrator - to following sides:

• organizations that process such information on our behalf, for example, technical service providers and judicial offices that provide consulting services;

• other administrators, such as couriers.

Your data will not be transferred to countries outside the European Economic Area (to the countries out of the European Union & Iceland, Norway and Liechtenstein too).
